Parties must obey Electoral Act Section 84(12) – Senate

The Senate has counseled that political parties comply with Section 84(12) of the Electoral Act 2022 following Wednesday’s judgment of the Court of Appeal in Abuja.

Senate spokesman and Chairman, Committee on Public Affairs, Dr. Ajibola Basiru, told reporters that it was in the parties’ best interest to do so.

The appellate court repealed a ruling of the Federal High Court in Umuahia, Abia State, which nullified the controversial Section 84 (12) of the Electoral Act 2022.

It held that the lower court acted without jurisdiction when it ordered the Attorney-General of the Federation and Minister of Justice, Abubakar Malami, to delete the said provision from the newly amended electoral law.

Acknowledging the Court of Appeal decision, Basiru said: “The judgment of the Court of Appeal has invalidated the decision of the Federal High Court in Umuahia, Abia State with the implication that as of today, Section 84(12) of the Electoral Act 2022 is still an existing law in Nigeria.

“Without any ado, it is imperative that the provision should be adhered to by all political parties.”
